If you don't want to read the actual Terms of Use, here's what it's basically saying, in plain English:

  • Copyright: Everything on this site is copyrighted, so don't try to copy anything without asking.

  • Services: I provide my services like it says on my site, that's it.

  • Privacy: Don't worry, I'm not going to spam you, and I only share your info with well known and trustworthy third parties when necessary to do something like ship you a product.

  • Disclaimer: I am not responsible for anything bad that happens because of my services, not like it's going to.

    I: Preamble

    The following details the Terms and Conditions of Use ("Terms of Use") relating to GreenLeaf Imaging. By using this Site or utilizing my Services, You agree to be bound by these Terms of Use. If You do not agree to the Terms of Use, You may not use this Site or any Services provided by GreenLeaf Imaging.



    II: Terms

    The terms "Service," "Site," and "GreeLeaf Imaging" refer to this Website, the services it provides, and all Content and Works within it.

    The terms "Content" and "Works" refer to all content on this Site, including but not limited to Articles, Photographs ("Photos") and Graphics.

    The terms "I," "Me," "We" and "Mine" refer to Ariel Lepor, the owner of the Service.

    The terms "You" and "Your" refer to you, the Client or any visitor to this Site.



    III: Copyright

    GreenLeaf Imaging and all Content on this site (excluding Content in My portfolio when otherwise marked) is Copyright © 2006-09 by Ariel Lepor. All rights reserved.

    If you wish to re-use text (including but not limited to Articles in the blog), photos (including but not limited to those in the gallery), or any other Content, you must (a): request and receive express written permission, (b): attribute the work to Me and (c): not use the Work for any commercial purpose.

    Infringement on these copyright restrictions will result in Your prosecution to the fullest extent of the law.



    IV: Services

    I reserve the right to refuse My Services and Products to anyone, with or without reason.

    You agree that your use of My Services and Products will in no way be harmful or defamatory to Me or any Third Party in any way, including but not limited to emotional and/or physical damage.

    You agree that you will not reproduce, transfer, or sell any and all Services and Products purchased.

    All payments must be made via PayPal.


    Graphic Design

    I retain the full copyright on all logos, web designs, and other graphics until full payment has been completed. After payment, I retain the right to use and reuse the aforementioned graphics, including derivatives, for any purpose and without restriction.

    Throughout the design process, You will be responsible for providing any needed feedback, images, copy, and other files by the timeline agreed upon. Failure to do so risks a delayed completion of the project and/or increased price.

    At the onset of a project, we will agree upon a fixed price for specific services that include a set number of designs, features, and so on. After the price and project scope has been specified, extra requests (such as for more designs, revisions, or website features) will both incur an additional fee at $60USD per hour and cause the completion of the project to be delayed.


    Photography

    All photos are Copyright © 2006-2009 by Ariel Lepor. All rights reserved. You may use photos only when given express written permission, only for the purpose allowed and when following specified restrictions. Photos you purchase, including but not limited to prints and downloads, may not be reproduced.

    You are licensed to use purchased photos only (a) after full payment has been made and (b) only for personal, non commercial use (e.g. for Downloads, Your computer's desktop background; for Prints, in Your home).



    V: Privacy

    I do not share or sell any personally identifiable information You provide Me (i.e. Your Email Address, Telephone Number, or Physical Location) with Third Parties except when needed to provide a Service (including but not limited to the delivery of physical goods), when you give consent, or when otherwise required to by law.

    If I perform Logo or Web Design Services for You, I may publicize Your Product/Company Name along with a relevant Portfolio entry, except when requested otherwise. If given Your consent, I may also publicize Your Name and/or testimonial.

    Payments you make for Goods or Services are completed through PayPal, and all information you provide to them is bound by PayPal's own policies, not Mine. Note that credit card information You provide them is not shared with Me.

    Note that while I make an effort to protect Your information, I am not responsible for any data that gets lost or stolen.



    VI: Disclaimer

    I make no guarantees, explicit or implied, including but not limited to those relating to my services.

    I disclaim all responsibility for any damage, including but not limited to physical and/or emotional damage, that results from this Site or any Services provided.
